3. Commission and Fees

We charge a commission for the services we provide, as outlined below:

3.1 Commission for Vehicle Transactions

  • Buyer's Commission: If you engage us to help purchase a vehicle, we charge a commission based on the sale price of the vehicle. The commission percentage will be specified at the time of agreement and typically ranges from 5% to 10%.

  • Seller's Commission: If you are selling a vehicle through our brokerage services, we charge a commission on the final sale price of the vehicle. This commission is typically between 5% to 10% of the sale price and will be disclosed before the sale is finalized.

3.2 Commission for Vehicle Shipping

  • For vehicle shipping services, we may charge a brokerage fee to coordinate with transport companies. This fee is separate from the cost of the actual shipping, which will be paid directly to the carrier. The brokerage fee will be disclosed during the booking process.

3.3 Commission Payment Terms

  • Payment Due: The commission is due upon completion of the transaction, whether it’s the purchase of a vehicle or the successful completion of a shipment. This is typically paid directly to us within 3 days of the transaction's closure.

  • Payment Method: Commission payments may be made via bank transfer, credit card, or other accepted methods.

  • Non-Refundable: All commissions and fees are non-refundable once a transaction is completed.

4. Customer Obligations

  • Accurate Information: You agree to provide accurate, up-to-date information when using our services (including vehicle preferences, delivery addresses, and payment details).

  • Legal Compliance: You agree to comply with all local, state, and federal laws related to the purchase, sale, and shipping of vehicles.

  • Vehicle Readiness: If you are selling a vehicle, you must ensure that the vehicle is in a saleable condition and free of any legal encumbrances.

  • Cancellation Policy: If you cancel a transaction or service after an agreement has been made or after fees have been incurred, you may be subject to cancellation fees.

5. Our Obligations

  • Transparency: We will provide you with clear, transparent terms regarding our fees, commissions, and services at the time of agreement.

  • No Hidden Fees: We will not charge you any additional fees without prior disclosure and consent.

  • Service Delivery: We will work diligently to complete the services agreed upon, including vehicle sourcing, purchase facilitation, and transport arrangements, in a timely manner.

6. Payment and Refund Policy

  • Commission Payment: Commission payments are due upon the successful completion of the service. You agree to settle all payments promptly upon the conclusion of the transaction.

  • Refunds: All payments made for services rendered are non-refundable. If there is a failure in fulfilling the service on our end (e.g., a canceled transaction due to our fault), we will work with you to resolve the issue, which may include partial refunds or credits for future services.

  • Chargebacks: In the event of a chargeback initiated by the customer for services rendered, the customer will be responsible for all associated fees, including the chargeback fee and any legal or administrative costs.

7. Limitation of Liability

  • Disclaimer of Warranties: We provide our services “as is” and do not make any warranties or guarantees, express or implied, regarding the vehicles or shipping services. We do not guarantee the condition, quality, or performance of the vehicles purchased through our services.

  • Liability: Spec Finder is not liable for any loss, damage, or injury caused by the vehicle after the transaction is completed or the vehicle is delivered to you. Our liability is limited to the commission fee paid for the brokerage service.

  • Third-Party Services: We are not liable for any issues arising from third-party services, including shipping carriers, sellers, or other entities we may work with on your behalf.

8. Confidentiality and Data Protection

9. Termination

Either party may terminate this Agreement at any time if:

  • The other party breaches any material term of this Agreement.

  • Either party fails to perform its obligations under this Agreement.

Upon termination, any outstanding commissions or fees will still be due and payable.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any disputes arising from this Agreement will be resolved in the courts located in Kansas.

11. Dispute Resolution

Any disputes arising under or in connection with this Agreement shall first be addressed through negotiation and mediation. If the dispute cannot be resolved through these means, it shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

12. Changes to Terms
